WELCOME TO D.R.O.P. LOYALTY PROGRAM (“D.R.O.P.” OR THE “PROGRAM”) OFFERED BY GREEN SHEEP, INC DBA OPEN WATER (“OPEN WATER,” “WE,” “US,” OR “OUR”). BY ENROLLING, ACCESSING, AND/OR OTHERWISE PARTICIPATING IN D.R.O.P., YOU AGREE THAT YOU HAVE READ AND YOU UNDERSTAND THESE PROGRAM TERMS AND CONDITIONS (“PROGRAM TERMS AND CONDITIONS” OR “D.R.O.P. TERMS AND CONDITIONS”) AND AGREE TO BE BOUND BY THEM. PLEASE READ THESE PROGRAM TERMS CAREFULLY. THEY INCLUDE LIMITATIONS ON Open Water’S LIABILITY, A BINDING ARBITRATION CLAUSE FOR RESOLUTION OF DISPUTES, WHICH MEANS A JURY WIL NOT HEAR POTENTIAL CLAIMS, AND CLASS ACTION WAIVER. WE MAY UPDATE AND MODIFY THESE PROGRAM TERMS AND CONDITIONS FROM TIME TO TIME WITHOUT NOTICE, AND THOSE CHANGES WILL BE EFFECTIVE ON THE “LAST UPDATED” DATE SHOWN ABOVE IN THE REVISED PROGRAM TERMS AND CONDITIONS. WE RESERVE THE RIGHT TO CANCEL OR MODIFY THIS PROGRAM AT ANY TIME.

IN OTHER WORDS, THESE ARE THE GROUND RULES FOR TAKING PART IN D.R.O.P., AND BY PARTICIPATING YOU AGREE TO FOLLOW THE PROGRAM TERMS AND CONDITIONS. MAKE SENSE? IT’S A BINDING AGREEMENT. 1. First things first. Website Terms of Use + Privacy Policy

In addition to these Program Terms and Conditions, your participation in D.R.O.P. is subject to our Website Terms of Service, which are made a part of these Program Terms and Conditions and are expressly incorporated herein by this reference. Please read the Website Terms of Service before participating in D.R.O.P. This Program is included in the definition of “Service” as that term is used in the Website Terms of Service. If there’s ever a direct conflict or inconsistency between D.R.O.P. Program Terms and Conditions and Open Water’s Website Terms of Service, these Program Terms and Conditions will control to the extent the conflict relates specifically to D.R.O.P. Otherwise, the Website Terms of Service continue to apply in full.

Information collected in connection with D.R.O.P. is governed by Open Water’s Privacy Policy (“Open Water Privacy Policy”) which you can find HERE which is made a part of these Program Terms and Conditions and is expressly incorporated herein by this reference. Please read the Open Water Privacy Policy as it explains how we collect, use and share your personal information and includes information about how to update or change the ways Open Water communicates with you. If there is any inconsistency between these Program Terms and Conditions and the Open Water Privacy Policy, the Open Water Privacy Policy will control. In addition, California law requires we disclose specific information about financial incentives we offer, and Colorado requires similar information when it comes to “Bona Fide Loyalty Programs.” Other states may have similar laws. By participating in D.R.O.P., you are consenting to the privacy practices described in the Open Water Privacy Policy.

As a condition of membership in D.R.O.P., you will be asked to provide a valid email when you enroll, which Open Water and authorized third parties will use to communicate with you about your account and as otherwise permitted by applicable law in accordance with our Privacy Policy. You may also be presented with an opportunity to indicate your preferences for optional marketing communications. You are not required to consent to marketing communications in order to join D.R.O.P.

When you sign up for D.R.O.P., you will also have the option to provide your mobile number, but it’s not required. Participants who choose to opt-in to SMS marketing acknowledge that Open Water or authorized third parties may send them commercial text messages using automated technology and you consent and agree to that type of contact. Note that some optional features or assignments within the Program may require opt-in to SMS marketing to participate. If this is the case, you will be provided with notice before you choose to participate in that particular activity. Some Open Water superfans may have previously signed up to receive marketing text messages from us. We want to let you know that by enrolling in D.R.O.P., you’ll also hear from us with loyalty-related updates (like 💧DROPS balance and perks info) via text. You can opt out at any time.

2. Who is eligible to join the D.R.O.P. organization and help take down BIG PLASTIC?

D.R.O.P. is open to U.S. residents of the fifty (50) United States and the District of Columbia (“D.C.”) who are at least eighteen (18) years of age or older with legal capacity to enter into a contract at the time of sign-up. Participation is limited to individuals for personal use only and is limited to one (1) account per person. Membership in D.R.O.P. is entirely voluntary and does not require a purchase or any other cost or fee to join. We might call you a “member” or “participant” or by other tier level names (“canalyst”, “general canager”, “can-xecutive”, or “chief can officer”) in these Program Terms and Conditions and related communications. Just because you are a member of D.R.O.P. doesn’t mean you are enrolled in or have any benefits in similar programs of any other Open Water affiliate or parent company. We may request proof of eligibility from you at our discretion. This Program is void where prohibited by law.

3. Basically, here’s how it works

Eligible participants in D.R.O.P. can earn “💧DROPS” in two (2) ways. First, you can earn 💧DROPS for making qualifying purchases on drinkopenwater.com (“Website”) as further described in Section 6 below. Second, you can earn 💧DROPS for interacting with Open Water in other ways that we dream up (“assignments”) as further described in Section 11 below and as may be updated by us from time to time. (Other brands might call them “points,” but obviously “points” sounds lame and boring, so we’re calling them “💧DROPS”, which makes way more sense with who Open Water is, plus “💧DROPS” just sounds cooler). You start accumulating 💧DROPS for purchases and other assignments completed on and after your date of enrollment. When you have enough 💧DROPS, you can redeem them for various products, discounts, and other offers (each a “Perk”) subject to availability and as further described in Section 12 below. Together, your 💧DROPS, perks, account status and all other Program benefits may be collectively referred to as “Program Offers.” All transactions involving 💧DROPS (earning and redeeming) are subject to review and verification by Open Water.

4. Changes to D.R.O.P. and these Program Terms and Conditions (LIFE CHANGES AND YOU’VE GOT TO CHANGE WITH IT).

The Program and its benefits are offered by us at our sole discretion. Things come up, life changes…BIG PLASTIC might catch wind of what we’re doing and try to shut us down…who knows. So, in that spirit, Open Water reserves the right to change, modify and/or cancel D.R.O.P., any aspect of D.R.O.P., or any portion of these Program Terms and Conditions (or any other policies related to this Program) from time to time, without advance notice to you in our sole discretion. This includes, without limitation, changes to 💧DROPS conversion or perks offered even if such changes may impact your ability to use 💧DROPS you have already earned. If Open Water decides to change these Program Terms and Conditions, we will post an updated version HERE (or another URL that Open Water may designate) with an update to the “last updated” date located at the top of these Program Terms and Conditions. We may also choose to send an email notifying you of any such changes, but we are not obligated to do so, and you waive any right you might have to such notice. Members should check this page periodically for updates. ANY CHANGES TO THESE Perk TERMS WILL BE EFFECTIVE UPON POSTING THE REVISIONS. Your continued participation in or access to D.R.O.P. in any way (e.g., logging in to your D.R.O.P. account, earning or redeeming 💧DROPS) after we post any changes confirms you agree to the Program Terms and Conditions as modified. In the event we cancel D.R.O.P. for any reason, your membership terminates, and all Program Offers, including 💧DROPS and perks, may be voided.

5. Want to know how to join?

You can voluntarily enroll in D.R.O.P. on our Website HERE. Follow the prompts to create an account and enroll in D.R.O.P.. Required information for sign-up includes your first and last name, valid email address, and password . Your account will give you access to our online shopping experience and the Loyalty Program. If you already have an account set up on our Website and want to join D.R.O.P., you can click the “Sign Up” button on that same page or otherwise follow the instructions made available by us on our Website and via D.R.O.P. dashboard accessed from our Website (“Loyalty Dash”) to enroll. Following enrollment, you can also optionally elect to complete your profile with additional information like your birthday, home address, future product “wish list,” and mobile phone number, or even a profile pic, but that’s your call. Some perks require additional information from you. For example, we need your address to ship physical perks, and we can’t send you a birthday surprise if you haven’t shared your birthday. Existing account holders may also receive an email from us with information and instructions about how to join D.R.O.P.. You won’t be able participate in D.R.O.P. until you acknowledge that you have reviewed and accepted the Program Terms and Conditions as well as our Website Terms of Use and Privacy Policy The information you provide must be true, accurate, and up to date.

6. Earning 💧DROPS by making purchases on drinkopenwater.com

Note: you MUST be logged into your account to earn. Purchases made while not logged in will not be eligible for 💧DROPS.

Following your enrollment in D.R.O.P., for every one-dollar ($1) you spend on qualifying purchases on our Website (pre-tax and shipping) you will be awarded ten (10) 💧DROPS. You must be logged into your D.R.O.P. account at the time you place your order on our Website to earn your 💧DROPS, and 💧DROPS are calculated on the actual purchase price paid, meaning after any discount, coupon, Perk redemption, or promotional offer is applied. For purposes of accruing 💧DROPS, taxes, shipping, and other fees will not be counted. 💧DROPS are rounded down to the nearest whole dollar spent and will be credited to your D.R.O.P. account after your qualifying order is processed. For example, a purchase of $19.75 = 190 💧DROPS. Previously awarded 💧DROPS may be deducted for any returns, credits, refunds, or voided transactions. This means if you earn 💧DROPS on an item you purchased on our Website and then return the item for a refund, we will deduct the 💧DROPS based on the value of the returned item(s). If due to such a return your account has a negative 💧DROPS balance, 💧DROPS earned in the future will be applied to the negative balance until the return amount is satisfied. If this happens, we can also adjust or cancel pending perks at our discretion. Additional exclusions may apply. For example, you can’t earn 💧DROPS on purchases of gift cards, donations or other fees (if any). We reserve the right to impose limits on the numbers of 💧DROPS you can earn should we deem it necessary.

7. 💧DROPS balance

You may access and update your information and access your account status, including 💧DROPS balance, by logging in to your D.R.O.P. account. 💧DROPS will typically appear in your account within one (1) to two (2) business days of the date your qualifying purchase at drinkopenwater.com is processed. 💧DROPS earned in connection with other assignments will typically appear within the time period identified in connection with each Activity, or if no time period is identified, within three (3) business days of your verified completion of the applicable Activity.

8. All good 💧DROPS must come to an end (or 💧DROPS Expiration, if you want to get technical about it)

💧DROPS ARE VALID ONE (1) YEAR FROM THE DATE THEY ARE EARNED, WHETHER THROUGH WEBSITE PURCHASES OR assignments. ALL UNUSED 💧DROPS AUTOMATICALLY EXPIRE ONE (1) YEAR FROM THE DATE THEY ARE EARNED WITHOUT ANY FURTHER NOTICE FROM Open Water. This means that your 💧DROPS may expire on different dates depending on when you earned them. Expiration of 💧DROPS is subject only to notice to you that is required by law, if any.

10. Stop trying to be retro

Don’t forget, you must be logged into your D.R.O.P. account at the time you place your order on our Website because we need to know who you are in order to award you those 💧DROPS. 💧DROPS will not be awarded, for example, if you check out as a “guest.” Except as Open Water may permit on a case-by-case basis in its sole discretion, 💧DROPS will not be awarded retroactively. In other words, if you make a purchase on the Website and aren’t logged in, 💧DROPS will not be later credited. 💧DROPS will not be awarded for purchases or other assignments made prior to your enrollment in D.R.O.P.

11. Earning 💧DROPS via mission critical “assignments”

(Note again: You must be logged in to your account to earn). 💧DROPS-earning assignments include, but are not limited to, those outlined below and may be updated by us from time to time.

12. What do all those 💧DROPS get you anyway? The answer is perks!

You can redeem your earned 💧DROPS currently available on your account for various perks. The required number of 💧DROPS will then be subtracted from your 💧DROPS balance following your Perk selection. Redemptions are final. Perks may change over time depending on availability as well as member interest. Current perks and the number of 💧DROPS required to redeem, as well as additional instructions related to specific perks, are available on the Loyalty Dash. There may be a limited number of particular perks available, and those perks will be provided on a first-come, first-served basis while supplies last. Open Water reserves the right to modify, amend, or revise the perks or any Program Offers. Participants may not rely on the continued availability of a particular Perk. The number of 💧DROPS required to redeem a Perk may be substantially increased, any Perk may be withdrawn, and restrictions on redemption may be imposed by Open Water or the third party supplying the Perk (if any). Physical perks will be shipped to U.S. addresses only (Continental U.S. and DC, no P.O. Boxes). Open Water reserves the right to substitute perks of comparable or greater value if any Perk becomes unavailable for any reason. Unless otherwise specified, physical perks will be fulfilled within twelve weeks from the date of redemption. Perks pictured in any point-of-sale, online, promotional packaging, advertising, and/or other Open Water materials are for illustrative purposes only. The actual Perk may vary from the Perk pictured.

Perks Expiration: Perks in the form of discounts or free shipping on our Website must be used within 30 days from issuance, unless otherwise indicated. Some Perks (e.g., gift cards or concert tickets) require you to schedule, attend, complete a specific action, or provide additional information (such as a home address) to claim them. If you redeem your 💧DROPS for one of these and don’t show up, don’t respond, or otherwise fail to complete the required steps to claim your Perk within 30 days from redemption (unless otherwise indicated), the Perk will be considered forfeited, and your 💧DROPS will not be refunded or reinstated. We’ll do our best to give you reminders, but it’s up to you to follow through. You acknowledge that Open Water has not made any representation, warranty or guarantee, express or implied with respect to any Program Offer. Perks include, but are not limited to, those outlined below and may be updated by us from time to time.

13. D.R.O.P. membership levels

Everyone begins at Level 1 upon joining and can climb to higher levels by accumulating 💧DROPS. Tier status is based on total 💧DROPS earned within the calendar year (January 1st -December 31st). All 💧DROPS counting towards the next membership level will restart at the beginning of each calendar year. If you reach Level 2 or Level 3, you will retain that status for the life your membership in D.R.O.P. as long as you make at least one (1) purchase of any value on drinkopenwater.com during the calendar year. If you don’t make a purchase at drinkopenwater.com for all of the applicable calendar year, your status will be reset to Tier 1 the next Jan 1st. Note! You can redeem 💧DROPS along the way and still reach the next tier because we keep track of when your total hits the threshold.

14. 💧DROPS Don’t Have Cash Value (Obviously)

💧DROPS, perks, and/or any other Program Offers under D.R.O.P. are promotional and have no cash or other pecuniary value, cannot be exchanged for cash, are not gift certificates, and have no value outside of this Program. Program Offers cannot be sold, shared, gifted, assigned, bartered, or otherwise transferred, provided that if a Perk is expressly transferrable, you can transfer such Perk in accordance with its specific, applicable terms. You cannot combine your 💧DROPS or other Program Offers with the Program Offers of any other participant in the Program. No credit or cash will be given for unused 💧DROPS. You have no ownership interest in 💧DROPS, perks, your account, or any other Program Offers and Program Offers may be revoked by Open Water at any time as set forth in these Program Terms and Conditions. Use of the word “earn” is meant to mean “collect” and “spend” is meant to mean “use.”

15. Members Aren’t Actually Employees or Contractors

In the D.R.O.P. program, all tier level titles including but not limited to Canalyst, General Canager, Can-xecutive, and Chief Can Officer are promotional and have meaning outside of the Program. Even if you add the title to your professional LinkedIn profile, this does not create any working relationship or engagement between Open Water and the member.

16. Don’t Abuse the System

We know you wouldn’t do this, but the Program and its Program Offers are intended for individual, personal use only. If you are a business or are purchasing products for resale or commercial purposes, you are not eligible to earn 💧DROPS on those purchases. We reserve the right to review and void any 💧DROPS on purchases that we determine, in our sole discretion, were made for resale or commercial use. And just in case you were wondering, teams, clubs or similar groups of individuals are also not eligible to participate. We can support businesses and these organizations in other ways though. Express interest here.

16. We have the last word on those 💧DROPS. Redemptions are final.

If you reasonably believe 💧DROPS were not properly credited to your account, you must notify us by contacting info@drinkopenwater.com within thirty (30) days of the date on which such 💧DROPS should have been awarded per these Program Terms and Conditions. You agree that our determination with respect to 💧DROPS accrued shall be final. Open Water reserves the right to determine the number of 💧DROPS in your account based on our internal records. Our internal records will be deemed accurate and in the event of any inconsistency between the number of 💧DROPS stated in your account and Open Water’s records, our records control. We can adjust or void 💧DROPS at any time, consistent with these Program Terms and Conditions.

Once you redeem your 💧DROPS for perks (including Discount Codes), those 💧DROPS are considered used, and they won’t be refunded, reinstated or reversed. For example, if you trade your 💧DROPS for a Perk in the form of a Discount Code then use that Discount Code to make a purchase on our Website and then return the item you purchased using the Discount Code, your used Discount Code/💧DROPS will not be reinstated. If we determine there is some kind of rare 💧DROPS mishap, we may, at our discretion, reinstate 💧DROPS in limited circumstances.

17. Don’t Make HR Get Involved

We reserve the right to suspend, investigate, or terminate any membership and/or suspend or void Program Offers at any time with or without notice for any reason, including, without limitation, for ineligibility, suspected fraud or abuse (e.g., unusually rapid accrual of 💧DROPS), manipulation of the Program (including an individual registering more than one account), conduct inconsistent with these Program Terms and Conditions or our other policies, and/or for violation of any local, state, or federal laws. In the event your participation in the Program is terminated, all earning and redemption assignments will be suspended and all accumulated 💧DROPS and perks in your account are void upon the date of termination. Suspension or termination or similar actions taken by Open Water in connection with the Program, such as 💧DROPS adjustment, will in each case be final and conclusive. Fraud or abuse including use of D.R.O.P. for unlawful or unauthorized purposes by members may not only result in cancellation of your membership but may impact your eligibility for participation in other Open Water programs. Open Water will have the right to take appropriate administrative or legal action as it deems necessary in its sole discretion. We’ll always aim to communicate clearly and fairly, but all questions or disputes regarding Program Offers, eligibility, awarding or earning of 💧DROPS or your compliance with these Program Terms and Conditions will be resolved by Open Water in its sole discretion.

18. Community Feed: Your time to shine (if you want)

Certain Assignments in D.R.O.P. may give you the option to submit content (such as photos, captions, comments or other material in connection with earning 💧DROPS). Any such content you submit in connection with the Program is considered “User Comments“ as defined in our Website Terms of Use. Just to be clear, you agree to be bound by the "User Comments" Section in our Terms of Use located here which is expressly incorporated herein by reference. In addition, and without limiting the foregoing, the following Program-specific terms apply.

  • Your Submission and any public use is voluntary: If you choose to participate in certain assignments that require photo upload to earn 💧DROPS, you will need to complete the assignment in order to receive those 💧DROPS. Separately, when you upload, we may ask you if you would like to give us permission to share your submissions publicly on the Community Feed as well as other Open Water digital channels. The feature is entirely optional. Whether or not you give us that permission will not affect your ability to earn 💧DROPS. If you allow us to share it, the content may be posted with your profile info (including your first name and profile pic) and will then be visible to other users. If you don’t allow us to share it, your content will only be used to validate and award your 💧DROPS.
  • Our Review Process: All User Contributions are subject to our review and approval before being posted. We reserve the right to accept or reject any content in our sole discretion, and we are not obligated to post anything you submit. We may, at our discretion, edit or remove any User Contributions that we have otherwise previously shared publicly at any time, for any reason, including complying with legal requirements.
  • No Comments from Others: There is no direct posting to the Community Feed. You cannot publish content directly on the Community Feed and other members will not be able to comment on the User Contributions posted. However, you may view member User Contributions as part of the Community Feed. Just to be clear--the Community Feed is a curated space. We don’t offer any open posting, commenting or messaging features.
  • License to use: By voluntarily providing User Contributions in connection with D.R.O.P. and opting to allow us to share your submission, you grant Open Water and its authorized designees a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and publicly display your User Contribution on the Program Community Feed as well as on Open Water social media and other marketing channels and digital platforms (e.g., our Website) for promotional and commercial purposes, with no obligation to provide notice, attribution, or compensation.
  • Content Standards: User Contributions cannot: (a) be sexually explicit or suggestive, profane, pornographic, violent or derogatory of any ethnic, racial, gender, religious, or age group, contain or reference any hateful, dangerous or illegal activity; (b) contain third-party trademarks, logos or contain any personal identification, such as license plate numbers, personal names, or street addresses; (c) contain copyrighted materials owned by others without permission. By providing any User Contributions you confirm that: (a) you will only upload original photos that you own or control (meaning you took it or have all necessary rights and permissions to submit it); (b) other individuals appearing in the photo, if any, have given express consent to be photographed and to the use as contemplated by these Program Terms and Conditions, and minors depicted, if any, are your children or legal wards or you have the express consent of the minor’s parent/legal guardian (proof of written permission to be provided to us upon request); and (c) your content does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity.

19. Special Offers

We may occasionally offer limited-time bonus 💧DROPS opportunities or additional ways to earn 💧DROPS. If we do, we will tell you how those work at the time, including requirements, additional terms that must be met or accepted, timing and any other relevant details. These opportunities may vary, and participation is always voluntary.

20. Sweepstakes Opportunities

From time to time, Open Water may provide Program members opportunities to earn entries into sweepstakes chance drawings in connection with the Program (“Sweepstakes”). In those instances, your participation in a qualifying Assignment (e.g., submitting a photo or other Assignment announced by Open Water) may earn you an entry into a Sweepstakes in addition to earning the applicable 💧DROPS. The specific details regarding how to enter, entry period, prizes, or other conditions will be described in the applicable promotional terms communicated at the time of the offer (“Sweepstakes Details”). For clarity, “Sweepstakes” are included in the defined term “Program Offers” as laid out in these Program Terms and Conditions above.

In addition, from time to time, Open Water may provide Program members opportunities to redeem 💧DROPS for entries into sweepstakes chance drawings in connection with the Program (“Sweepstakes”).

NO PURCHASE NECESSARY. No purchase is required to enter or win, and a purchase will not increase or improve your chances of winning in connection with any Sweepstakes.

Eligibility. Such Sweepstakes are open to U.S. & D.C. residents,18+ with legal capacity to enter into a contract at the time of entry. Employees, officers, and directors of Open Water, its parent companies, affiliates and agencies, and their immediate family members and household members are not eligible to win prizes in Sweepstakes tied to the Program.

To enter. To enter, you must be a member of D.R.O.P.. During the designated Sweepstakes entry period, non-members can sign up for D.R.O.P. for free. Unless otherwise indicated, completion of the designated Assignment OR redemption of 💧DROPS for one (1) raffle ticket will earn one (1) Sweepstakes entry. You may redeem 💧DROPS for as many entries as you like during the entry period. Open Water’s computer is the official time-keeping device for any Sweepstakes.

Winner Selection and Odds. Potential winners, subject to verification, will be selected at random by Open Water or an authorized representative of Open Water, from among all eligible entries received during the entry period. Odds of winning depend on the number of eligible entries received. Drawings will be held within approximately one (1) week from the close of the entry period.

Prizes. Prizes and the approximate retail value (“ARV”) will be stated in the Sweepstakes Details. Prizes are non-transferable, and no substitution or cash redemption is permitted except at Open Water’s discretion. Unless otherwise indicated in the Sweepstakes Details, prizes will be fulfilled within approximately 4-6 weeks after the conclusion of the Sweepstakes and verification of winners’ eligibility and compliance with the Program Terms. All prizes are awarded “as is” without warranty of any kind, express or implied, on the part of Open Water. Winners agree to look to the manufacturer or supplier of the prize for any warranty on the prize or for any damages arising out of acceptance or use of the prize. In the case of third-party gift cards, gift cards are subject to the terms of the issuer. No more than the listed number of prizes will be awarded.

Notification. Potential winners will be notified using the contact information associated with their Program account. If a potential winner does not respond within three (3) days, or if eligibility cannot be verified, the prize may be forfeited and awarded to an alternate winner. Potential winners may be required to sign and return an Affidavit of Eligibility and Liability Release and, where legal, a Publicity Release (collectively the “Winner Documents”). If required, the Winner Documents must be returned by the date stated in the notification email or the prize will be forfeited and awarded to an alternate winner.

Publicity. Acceptance of a prize constitutes each winner’s agreement and consent that Open Water may use the winner’s name, city, state, likeness, photo, and/or prize information in connection with the Sweepstakes for promotional, marketing, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.

Winners List. To obtain a list of winners, email hey@drinkopenwater.com within sixty (60) days after the end date of the applicable Sweepstakes.

Additional Terms. Sweepstakes are void where prohibited by law and subject to all applicable federal, state, and local laws. In the event of any conflict between these Program Terms and Conditions and the Sweepstakes Details, the Sweepstakes Details will control. A Program related Sweepstakes may be promoted via social media, however, such Sweepstakes are in no way sponsored, endorsed, or administered by, or associated with Instagram, Meta, TikTok or X. By participating, you release the applicable platform from any responsibility related to the Sweepstakes. Open Water LLC is the sponsor of all Program related Sweepstakes.

21. Are you Quiet Quitting?

We reserve the right to terminate or suspend any account that has no qualifying participation for twelve (12) months. We may do this without providing any notice to you. You can always rejoin later as an entry level Canalyst again. Qualifying participation includes simply logging in, updating your profile, earning or redeeming 💧DROPS, completing an Assignment or any other action we count as participation.

22. Real People Only

Please don’t use bots, scripts or other automated means to interact with D.R.O.P.. We love tech, but only when it plays fair. Automated tools that try to game the system will get shut down—and so will your account.

23. Stuff that’s out of our control (but still annoying)

We are not responsible for any problems, or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail as a result of technical problems or traffic congestion on the Internet or at any website, including any resulting error in computing qualifying purchases or any unavailability of perks, or any injury or damage to any participant's or any other person's computer or mobile device related to or resulting from participation in D.R.O.P.. If, for any reason, the Program is not capable of running as planned, including due to errors of any kind or nature (technical or human), infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, acts of God, acts or omissions of third parties (e.g., Perk fulfillment providers), or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Program, we reserve the right in our sole discretion to cancel, terminate, modify, or suspend the Program or otherwise respond to the circumstances as Open Water deems appropriate.

Despite best efforts, errors do occasionally happen. We reserve the right to correct such errors at any time even if it impacts pending 💧DROPS or other Program Offers. This could mean an adjustment to your account status or 💧DROPS balance at any time, without notice, due to technical errors or miscalculations or other reasons which Open Water determines is appropriate.

24. This account is for you and you alone.

You can only have one account registered to you. Open Water may, at its sole discretion, suspend, cancel or combine accounts that appear to be duplicative. You are responsible for the accuracy and completeness of the information you provide. Failure to keep your account information current and complete may result in forfeiture or lapsing of Program Offers. Open Water is not responsible for any Program Offers you may miss due to incomplete or incorrect account information. In the event of a dispute over the identity of a member, we will look to the registered account holder of the email address associated with the account. A member may be required to show proof of being the registered account holder of such email address. This is defined as the person assigned to an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses.

You are responsible for keeping your password and any account credentials confidential and for making sure that no unauthorized person has access to your account. You are responsible for all assignments that occur under your password, and we may rely on the authority of anyone accessing your account or using your account credentials. You agree to let us know about any unauthorized activity or other breach of security on your account. If you notify us that your account is no longer secure or accessible to you, we may deactivate it at our discretion to prevent misuse.

25. Indemnification (Responsibility for claims)

Just to be clear, you agree to be bound by the Indemnification Section in our Website Terms of Service which is expressly incorporated herein by reference. Without limiting the foregoing and except to the extent prohibited under applicable law, you agree to indemnify, defend, and hold harmless Open Water, its parents, subsidiaries, divisions and affiliates, and each of their respective officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, or expenses, including attorneys’ fees and costs, that may arise from or in connection with (a) violation of these Program Terms and Conditions by you or anyone acting on your behalf; (b) any User Comments you provide; and (c) your violation of any law or the rights of a third-party.

WITHOUT LIMITING THE FOREGOING, THIS MEANS THAT YOU WILL NOT HAVE THE RIGHT TO PURSUE A CLAIM IN COURT, OR HAVE A JURY DECIDE THE CLAIM, AND YOU WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS OR REPRESENTATIVE ACTION OR SIMILAR PROCEEDING IN COURT OR IN ARBITRATION TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. You also have the right to bring qualifying claims in small claims court, as indicated in our Website Terms of Service.

AS A CONDITION OF PARTICIPATING IN D.R.O.P., YOU AGREE THAT ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS PROGRAM, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.

28. General

  • Taxes: Program members are solely responsible for any federal, state, or local taxes and/or government fees that may be imposed in connection with the Program.
  • Waiver: No delay or failure by us to enforce any of these Program Terms and Conditions shall be a waiver of any of our rights.
  • Severability: The invalidity or unenforceability of any provision(s) of these Program Terms and Conditions shall not affect the validity or enforceability of any other provision. If any provision of these Program Terms and Conditions is found to be invalid or unenforceable, the Program Terms and Conditions shall be construed in accordance with their terms as if the invalid or unenforceable provision were not contained therein.
  • Construction: The (very clever, thank you very much) branded headings used in these Program Terms and Conditions are for convenience and fun only, are not a substantive part of these Program Terms and Conditions, and do not affect the interpretation of any of its provisions. Any reference to the term "including" means "including, without limitation."
  • Governing Law: All issues and questions regarding these Program Terms and Conditions or the rights and obligations of you or Open Water in connection with D.R.O.P. will be governed by the laws of the U.S. and the State of Illinois without regard to its conflicts of law provisions. This is consistent with the governing law provisions in our Website Terms of Use, which apply to this Program.
  • Message and data rates apply. Depending on how you access the Internet, the use of online services generally may result in access fees or data charges, so check with your Internet service/wireless service providers. (But you probably knew that already.)
  • Camera access. Access to your camera on your mobile device is requested only when necessary to enable features like taking photos in connection with certain 💧DROPS-earning assignments as well as uploading receipts for purchases made in real life.
  • Misc: We’ve done our best to lay out the key terms, limitations, and details for D.R.O.P., including how you can earn and redeem 💧DROPS and what to expect from perks. That said, we may apply additional eligibility criteria, restrictions, or conditions to certain assignments or perks — especially if something is time-sensitive or requires extra steps. Open Water reserves the right, in its sole discretion, to add, modify, or clarify limitations or exclusions at any time, including after a Perk is announced or claimed, if necessary to ensure fairness, safety, or compliance with laws, or to prevent abuse of D.R.O.P. In the event of any inconsistency or discrepancy between these Program Terms and Conditions and other statements contained in any related materials or advertising, these Program Terms and Conditions will control.

29. Had your fill of 💧DROPS?

To cancel your membership in D.R.O.P. at any time, log into your account and follow the prompts under your account settings to discontinue your participation and cancel your membership. You can also email us at info@drinkopenwater.com or call us at 1-305-771-1357. Your membership in D.R.O.P. will be terminated within thirty (30) days, and subject only to notice that may be required by law, all Program Offers will expire and become void upon the date of termination. If you do decide to cancel your enrollment in D.R.O.P. and you later re-enroll, you will be treated as a new member of D.R.O.P. Cancellation of your membership in D.R.O.P. will stop your ability to earn or redeem 💧DROPS but will not cancel your account.
